Welcome to EightMap ("we," "our," or "us"). These Terms of Use govern your access to and use of the EightMap software-as-a-service platform, website (eightmap.com), and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Description of Service

EightMap provides a Manufacturing Landscape Assessment and Mapping platform that allows users to map their factory's Technology (IT & OT assets), business processes, and people to generate AI readiness maturity scores and insights.

2. User Accounts

To access the platform, you must register for an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Customer Data and Privacy Liability

As a user, you may upload, input, or generate data, asset lists, process maps, and personnel information within the platform ("Customer Data"). Ownership: You retain all rights and ownership to your Customer Data. Responsibility and Liability: You are solely responsible for the accuracy, quality, legality, and privacy of all Customer Data you upload. EightMap acts merely as a data processor and hosting platform. We are not liable for any data privacy violations, compliance breaches, or legal claims arising from the specific data you choose to upload, store, or map within the platform. You must ensure you have the necessary rights and consents to upload such data.

4. No Guarantee of Operational Benefits

EightMap provides "Deep Insights," maturity ratings, and strategic roadmaps based on our proprietary analytical frameworks and the data you provide. Advisory Nature: All assessments, maturity scores, and recommendations generated by EightMap are strictly for informational and advisory purposes. No ROI Guarantee: EightMap does not guarantee any specific financial return, operational improvement, fixed amount of benefits, or successful digital transformation resulting from the use of our platform or its analysis. The successful implementation of Industry 4.0 or AI initiatives depends on factors outside of our control.

5. Intellectual Property

EightMap retains all right, title, and interest in and to the Service, including all software, platform architecture, methodology ("Map Once, Use Forever"), algorithms, and visual interfaces. You may not copy, modify, distribute, sell, or lease any part of our Service.

6. Limitation of Liability

To the maximum extent permitted by law, EightMap shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

7. Modifications to the Service and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We may also update these Terms from time to time. Continued use of the platform constitutes acceptance of the updated Terms.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of local government, without regard to its conflict of law provisions.
